On the evening of January 10, 2008, Michael B. Jackson, creator and host of Internet Talk Radio Program Prison Nation Radio and author of several books, was “effective immediately, suspended from conducting any Revocation Hearings or acting in any way as an agent of the NJ State Parole Board. On Thursday, January 17, 2008, @ 7:00PM Jackson will make a public statement concerning his suspension. Jackson also plans to give himself a “self-review” of the parole rules, in an attempt to “better understand the errors or my ways”. The broadcast can be heard online at www.Jointfx.com.
“As far as why I was suspended, I can’t comment too much right now because I haven’t been told anything. I was at home last Thursday watching the basketball game with my 6 year-old grand daughter and my wife brings me the phone”, said Jackson. The last time I got a phone call at home after hours from my boss it was to tell me that a friend and co-worker had died in a car wreck, but there were no details of exactly what happened. That was years ago. It felt something like that. “
A Revocation Hearing involves a parole officer, an accused parole violator and a Hearing Officer. It is a legal proceeding governed by clear rules and guidelines that EVERYONE must adhered. Basically, the purpose of the RH is to review the violation(s) to determine if a violation(s) has been committed. Every person accused of a parole violation has a legal right to a RH and the opportunity to defend him/herself. The standard for a RH is that the Parole Officer or State has the obligation to prove that a violation(s) have been committed via the presentation “CLEAR and CONVINCING” evidence. The Hearing Officer’s responsibility is to evaluates and consider the CLEARness, CONVINCINGness - and CORRECTness - of the evidence via a fair and objective process. At the conclusion of the hearing the HO prepares a report to the parole board with his/her findings, determinations and recommendation for further action in that case.
“I’ve been with the NJ Juvenile Justice System for 23 years and conducting revocation hearings for 10 years. I can’t figure it out, but it must be something important”, continued Jackson. “I’ve always had excellent job performance evaluations all around - up to this point anyway. Let’s wait and see what happens.”
